1. Introduction
Welcome to Fortunara! These Terms of Service ("Terms") govern your use of the Fortunara mobile application and any related services provided by us. By accessing or using our application, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the service.
2. Acceptance of Terms
By creating an account or using the Fortunara application, you signify your agreement to these Terms. Your continued use of the application after any modifications to these Terms constitutes your acceptance of the revised Terms.
3. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
4. User Accounts
When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our service. You are responsible for maintaining access to the email address or Apple ID used to authenticate with the service. Fortunara uses passwordless authentication — we do not store passwords. If you lose access to your authentication method, please contact us for account recovery assistance.
5. Acceptable Use
You agree to use the application only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the application. Prohibited behavior includes harassing or causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within our application.
6. Astrological Content Disclaimer
Fortunara provides astrological insights and market correlations for entertainment purposes only. All content — including aura scores, horoscopes, forecasts, and any market-related insights — is provided solely for entertainment and personal reflection. It should not be considered financial advice, investment recommendations, or predictions of future market performance. There is no established scientific evidence that astrological methods can predict market performance or financial outcomes. Any decisions made based on content within the app are made entirely at your own risk, and Fortunara bears no liability for any financial outcomes resulting from such decisions.
7. Prohibited Conduct
You may not use the application for any illegal or unauthorized purpose. You must not, in the use of the service, violate any laws in your jurisdiction (including but not limited to copyright laws). You may not attempt to reverse engineer, decompile, or hack the application.
8. Intellectual Property
The application and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Fortunara and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Fortunara.
9. User-Generated Content
By submitting content to Fortunara, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the service. You represent that you have all necessary rights to grant this license.
10. Disclaimers
Your use of the service is at your sole risk. The service is provided on an "AS IS" and "AS AVAILABLE" basis. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.
11. Limitation of Liability
In no event shall Fortunara, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
12. Indemnification
You agree to defend, indemnify, and hold harmless Fortunara and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).
13. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the service will immediately cease. If you wish to terminate your account, you may delete it directly from the Account section within the app. Account deletion is permanent and will remove your personal information from our systems. You may also contact us at support@fortunara.app to request account deletion.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
15. Severability
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our service.
